Nutzungsbedingungen
Welcome to what2visit. These Terms of Use ("Terms") govern your use of What2visit, except where we expressly state that other provisions apply, and provide information about the What2visit Service ("Service"), as described below. By creating a What2visit account or using What2visit, you agree to these terms. The What2visit Service is one of the products provided to you by BALUMA VENTURES SL, and thus, these Terms of Use constitute an agreement between you and that company.
What2visit Service
We agree to provide you with the What2visit Service. The Service includes all products, features, applications, services, technologies, and software offered by What2visit to fulfill the platform's purpose of connecting you and linking destinations with people and things you care about. The Service consists of the following:
- Offering personalized opportunities to create, connect, communicate, discover, and share. Each person is unique. In our effort to help strengthen your relationships, we want to do so through shared experiences that genuinely interest you. To this end, we create systems that aim to identify what things and people may interest you and others to help you create, find, and share relevant experiences, as well as participate in them. Part of this process involves highlighting content, features, offers, and accounts that may interest you and offering ways to experience What2visit based on what you and others do both within and outside the platform.
- Fostering a positive, inclusive, and safe environment. We develop and use tools and offer resources to members of our community to help them have positive and inclusive experiences, even when we believe they may need assistance. We also have teams and systems designed to combat abuse and violations of our Terms and policies and to eliminate harmful and misleading behavior. We use all the information we have, including yours, to protect our platform. Additionally, we may share information about misuse or harmful content with other BALUMA VENTURES SL companies or law enforcement authorities.
- Developing and using technologies to continuously provide services to our growing community. To offer our Service under optimal conditions, it is essential to organize and analyze information from our expanding community. Much of our Service involves creating and using advanced technologies to personalize, secure, and enhance our Service on a large scale to make it available to a broad international community. Technologies like artificial intelligence and machine learning enable us to apply complex processes across all our Services. These automated technologies also allow us to ensure the functionality and integrity of our Service.
- Providing consistent and seamless experiences across BALUMA VENTURES SL products. What2visit is part of the BALUMA VENTURES SL family of companies, sharing technologies, systems, insights, and information, including data we have about you, to provide better and safer services. We also enable interaction with the various BALUMA VENTURES SL products you use and have systems designed to offer a consistent and seamless experience across them.
- Ensuring access to our Service. To operate our global Service, we must store data on our systems worldwide, including locations outside your country of residence, and transfer information across these systems. Using this global infrastructure is necessary and essential to provide our Service. This infrastructure may be owned or directed by BALUMA VENTURES SL.
- Connecting you with brands, products, and services in ways that suit you. We use data from What2visit and other BALUMA VENTURES SL products and collaborate with external partners to show you ads, offers, and other advertising content we believe may interest you. We aim to make this content as interesting as the other experiences on What2visit.
- Researching and innovating. We use the information we have to develop, test, and improve our Service and collaborate with others to research ways to improve it and contribute to the well-being of our community. These actions include analyzing data about our users and understanding how our Services are used, such as by conducting surveys and tests and troubleshooting new features.
How Our Service Is Funded
Instead of paying to use What2visit, by using the Service referred to in these Terms, you agree that we may show you ads from companies and organizations that pay us to promote themselves within and outside BALUMA VENTURES SL's products. We use your personal data, such as information about your activity and interests, to show you ads that may interest you most. We show relevant and useful advertising without revealing your identity to advertisers. We do not sell your personal data. We allow advertisers to provide us with certain information, such as their business goals and the type of audience they want to reach with their ads, so we can show their advertising to people who may be interested in it. We also provide advertisers with reports on the performance of their ads to help them understand how people interact with their content, inside and outside What2visit. For example, we provide advertisers with general information about interests and demographics to help them better understand their audiences. We do not share information that directly identifies you (such as your name or email address, which could be used to contact you or discover your identity) unless you give us explicit permission to do so. You can access trademark-protected content posted by certain account holders promoting products or services as part of a business relationship they have with the business partners referred to in such content.
Data Policy
To provide our Service, we must collect and use your information. The Data Policy explains how we collect, use, and share information across BALUMA VENTURES SL's products. It also details how you can control your information, for example, through What2visit's security and privacy settings.
Your Commitments
We provide the Service to you in exchange for the following commitments. Who can use What2visit? We want our Service to be as inclusive and open as possible, but also safe and law-abiding. Therefore, if you want to be part of the What2visit community, you must agree to certain restrictions.
- You must be at least 14 years old.
- You must not have any prior record indicating you are prohibited from using any aspect of our Service under applicable law or using payment-related services if you appear on a list of people or companies with whom trade is prohibited or restricted.
- Your account must not have been previously disabled due to a violation of the law or any of our policies.
- You must not have been convicted of sexual offenses.
- Do not impersonate others or provide us with inaccurate information. Although you do not need to reveal your identity on What2visit, you must provide accurate and up-to-date information (including registration details), which may involve providing personal data. Also, you may not impersonate any other person or entity or create an account on behalf of another user (unless you have their express permission).
- Do not engage in illegal, deceptive, or fraudulent activities, nor for unlawful or unauthorized purposes.
- Do not violate these Terms or our policies (or help or encourage others to do so), especially What2visit's Community Standards, BALUMA VENTURES SL's Platform Terms, Developer Policies, and Intellectual Property Guidelines. If you post branded content, you must comply with our Branded Content Policies, which require you to use our specific tool for such content. You can find information on reporting inappropriate behavior or content in our Help Service.
- Do not take any action that interferes with the Service or prevents it from working as intended. Such actions include misuse of any reporting, complaint, or appeal channels (e.g., filing fraudulent or unfounded complaints or appeals).
- Do not attempt to collect or access information or create accounts using unauthorized means. This includes creating accounts or gathering information through automated means without our express permission.
- Do not sell or acquire accounts or data obtained from us or our Service, nor grant licenses in relation to them. This includes attempts to buy, sell, or transfer any aspect of your account (including username); to solicit, gather, or use badges or credentials from other users; to solicit or collect usernames or passwords from What2visit, or to misuse access identifiers.
- Do not post private or confidential information about others without their permission, nor take actions that infringe the rights of third parties, including intellectual and industrial property rights (e.g., copyright or trademark infringements, counterfeits, or pirated items). You may use another person's work in accordance with the limitations or exceptions set forth in copyright and related rights law, under applicable regulations. You represent yourself or have obtained all necessary rights regarding the content you post or share.
- Do not modify or translate our products or their components, nor create derivative works from them or reverse engineer them.
- Do not use a URL or domain name in your username without our prior written consent.
Permissions you grant us. As part of our agreement, you
also grant us
the permissions
necessary to provide you with the Service.
- We do not claim ownership of your content, but you grant us a license to use it. Your rights concerning the content do not change. We do not claim ownership of the content you post on or through the Service, and you can share it with anyone wherever you want. However, you must grant us certain legal permissions ("license") so we can provide the Service. When you share, post, or upload content protected by intellectual and industrial property rights (such as photos, texts, or videos) on or in connection with our Service, according to this agreement, you grant us a worldwide, non-exclusive, transferable, sublicensable, and royalty-free license to host, use, distribute, modify, maintain, reproduce, translate, and publicly display or communicate your content and to create derivative works (according to your privacy and app settings). The license will end when the content is deleted from our systems. The content may be deleted partially or fully (if the account is deleted). For more information on how we use your information and control or delete your content, review the What2visit Data Policy and visit the Help Service.
- Permission to use your username, profile picture, and information about your relationships with accounts, ads, and sponsored content and actions you take with respect to them. You grant us permission to display your username, profile picture, and information about actions you take (such as likes) or relationships you establish (such as content you choose to follow) alongside (or in connection with) accounts, offers, sponsored content, or ads you follow or interact with, displayed on Facebook Products, without obligating us to compensate you. For example, we may show that you like a sponsored post created by a brand that paid us to display their ads on What2visit. As with followers of other accounts and actions taken on other content, only people who have permission to view such content or followers will see followers of sponsored accounts and actions taken on sponsored content. We will also respect your ad settings.
- You agree that we may download and install updates to the Service on your device.
Additional Rights We Reserve
- We may remove any content or information you share on the Service if we consider it to violate these Terms of Use or our policies (including What2visit's Community Standards), or if required by law. We may also refuse to provide you with the Service or stop doing so, in whole or in part (for example, we may cancel or deactivate your access to BALUMA VENTURES SL and its companies' products) immediately, to protect our community or services, or if you pose a risk or legal exposure to us, violate these Terms of Use or our policies (including What2visit's Community Standards), repeatedly infringe third-party intellectual property rights, or if required by law. We may also cancel or modify the Service, remove or block content or information shared on it, or stop providing it, in whole or in part, if we determine it reasonably necessary to avoid or minimize adverse legal or regulatory consequences for us. When we remove content under certain conditions, we will inform you of this measure and explain the options available to you to request another review unless: you seriously or repeatedly violate these Terms; or if providing another review may expose us or others to legal liability; may harm our user community; may compromise or jeopardize the integrity or functionality of our services, systems, or products; or if we experience technical restrictions or are not permitted to do so by law. If you believe your account was disabled in error or wish to disable or permanently delete it, consult our Help Service.
